The Council adopts the Directive on EU civil liability rules

The Council has adopted a new Directive which adapts the EU’s civil liability rules in order to account for the particular digital features of modern products. The revision has been made to benefit consumers and encourage innovation by providing legal clarity. In particular, the Directive extends the definition of “product” to digital manufcaturing files and softwares. It also identifies the legal liability of a company or person, even when the product is reapired with a manufacturer other than the original one. Furthermore, it guarantees compesnation for damages for products imported from outside of the EU. Finally, it allows courts to allow claimants to prove only the likelihood of defectiveness of a product, where proof of defectiveness is excessively difficult. The Directive will enter into force twenty days after its publication in the Official Journal.
